PAIA Manual

Prepared in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA), as amended. It explains which LearnerLens records may be requested and how to make a request.

1. Purpose of this manual

PAIA gives a person a right to request access to records held by private bodies where the record is required for the exercise or protection of a right, subject to PAIA's grounds for refusal. This manual is a guide to making that request to LearnerLens.

3. The PAIA guide

The Information Regulator makes a guide available on how to use PAIA, including how to request access to a record, available assistance, remedies, fees and forms. The guide is available from the Information Regulator's PAIA page.

4. Records available without a formal PAIA request

The public pages on this website, including our Privacy Policy, Terms and Conditions, Disclaimer and this manual, are available without a PAIA request.

5. Records available under other legislation

PAIA manual and access-request records: Promotion of Access to Information Act 2 of 2000.

Personal-information, consent and privacy records: Protection of Personal Information Act 4 of 2013.

Electronic order, transaction and related customer-communication records: Electronic Communications and Transactions Act 25 of 2002.

Consumer transaction, support and complaint records, where applicable: Consumer Protection Act 68 of 2008.

Tax, accounting and payment records: applicable South African tax legislation, including the Income Tax Act 58 of 1962 and Tax Administration Act 28 of 2011.

6. Categories of records held by LearnerLens

Subject to PAIA, records may include business and financial records; customer, parent and learner account records; service-order, payment, communication and support records; consent records; reports and deliverables; and records needed to operate this website and meet legal obligations.

Learner information can include sensitive material supplied for a service, such as educational observations, learner details and copies of written schoolwork. Access to any record is considered case by case, with the privacy rights of children and other people protected as PAIA and POPIA require.

7. Processing of personal information under POPIA

Purpose: to provide and support the educational service requested, manage accounts and payments, communicate with parents, maintain consent and case records, and meet legal and accounting duties.

Data subjects: parents or guardians, learners, customers, people who contact LearnerLens and service providers. The information may include contact details, learner and case details, correspondence, payment references and the educational materials a parent chooses to provide.

Recipients: authorised LearnerLens staff and the service providers needed to operate the website, storage, payments, email and teacher-supervised work. See the Privacy Policy for the current description of processing and retention.

Planned transborder flows: some personal, account and case information is stored or processed outside South Africa, including in the production database hosted in Frankfurt, Germany (eu-central-1). LearnerLens does not state a geographic location for private file storage or another provider where that location has not been independently verified. Security: LearnerLens uses access controls and private storage paths for learner evidence. No security measure removes all risk; records are handled in line with applicable law and the nature of the information.

8. How to request access

Send a completed PAIA Form 2 to the Information Officer at info@learnerlens.co. The form and the current prescribed process are available on the Information Regulator's PAIA page.

Please identify the record clearly, provide the contact details needed for a response, and explain the right you seek to exercise or protect where PAIA requires this. Fees may apply as prescribed. LearnerLens will consider the request under PAIA and advise the requester of the outcome, any fee and available remedy.

9. Availability and updates

This PAIA Manual is available free at https://learnerlens.co/paia. A copy is available for public inspection at the LearnerLens physical address during normal business hours. A person may request a copy, with any prescribed copying fee applying only where law permits. LearnerLens will provide this manual to the Information Regulator on request. LearnerLens will review and update the manual when its information practices or applicable legal requirements materially change.
